ARTICLE 1

PURPOSE OF THE TERMS AND CONDITIONS AND DEFINITIONS

« Chatbot », « Service » or « Ask Mona »: means the appointment booking service provided by SAS ASKMONA to the User; « Site »: means the website www.askmona.fr and all associated pages; « User »: means any individual exchanging messages with Ask Mona, regardless of the conversational channel; « Conversational channel »: means the conversational means adopted by the User to interact with Ask Mona. There is only one conversational channel which is Facebook messenger (http://m.me/askmonaparis).

« ASKMONA »: refers to the company ASKMONA SAS, a simplified joint stock company with a capital of 200 euros, whose registered office is located at 14 rue Charles Darwin, identified in the Meaux Trade and Companies Register under number 827 747 874. The « clients » are the cultural or administrative institutions for which Ask Mona develops chatbots.

ARTICLE 2.

SCOPE OF APPLICATION

The GCU define the terms of use of the site and the chatbot including all content and functionality accessible on the said site and by conversation with Ask Mona, whatever the conversational channel. They also apply to chatbots designed by Ask Mona for its customers. Any use of the services offered on the Website and by conversation requires adherence to these TOU. They are part of the Terms of Use of Facebook, previously accepted by the user.

ARTICLE 3.

REGISTRATION, ACCESS AND USE OF THE CHATBOT AND THE SERVICE

3.1 User registration

To access the chatbot and the service, the user must initiate a conversation with Ask Mona directly through the chat channel. During the first contact with Ask Mona, the User undertakes to provide a valid first name and to read these TOS. The User is responsible for the use of his contact details and his device. The User is informed that any third party using hisher device can potentially use the Service on hisher behalf. Consequently, to limit this risk, the User is invited to secure access to hisher device. The User agrees to use the Ask Mona Service only for the purposes permitted by the TOS, and any laws, regulations or generally accepted practices or guidelines in the relevant jurisdictions. Accordingly, the User acknowledges that heshe is solely responsible to Ask Mona for all actions taken on the basis of hisher data provided during registration. If the User becomes aware of any unauthorised use of the service on hisher behalf, he/she agrees to inform Ask Mona without delay at the following e-mail address: contact@askmona.fr. The User authorises SAS ASKMONA by the present GTU to record and use, by computer processing, the information provided by the User. SAS ASKMONA shall not be held responsible for any loss or damage arising from a breach of the obligations of this article.

3.2. Availability of the service

The service is available seven days a week and twenty-four hours a day. The service may be interrupted for curative maintenance purposes, without prior notice to the User.

Consequently, SAS ASKMONA cannot guarantee the availability of the site and the service, the reliability of transmissions and performance in terms of response time or quality. No technical assistance is provided to the user. SAS ASKMONA shall not be held liable in the event of impossibility of access to the site or the service. Furthermore, SAS ASKMONA may interrupt the site and/or the service at any time without prior notice and without any right to compensation. The user acknowledges and accepts that SAS ASKMONA is not responsible for any interruptions, and for the consequences that may result for the user or any third party.

3.3. Use of the service

Under no circumstances shall SAS ASKMONA be liable for the quality of the content of the service, for loss or damage of any kind resulting from the use of the service. The service may contain links to third party content that does not originate from SAS ASKMONA. SAS ASKMONA does not endorse or assume any responsibility for such third party sites, information, content, products, or services. The user’s use of such third party sites or services is at his own risk.

3.4. Banning from the service

In case of non-compliance with the TOS by a user, SAS ASKMONA reserves the right to restrict access to Ask Mona to the said user, without prior notice. SAS ASKMONA does not assume any responsibility for the consequences of the termination of the service for the user.

ARTICLE 4.

PROTECTION OF PRIVACY AND PERSONAL DATA

4.1. Personal data

Ask Mona may collect and keep copies of messages exchanged between Ask Mona or a chatbot and the User. The personal data of chatbot Users is kept for 3 years from the last exchange and on behalf of the Client of the chatbot concerned, who is responsible for processing.

The participation data of the contests are kept until the results of the contests and then archived for 3 years.

Personal data is kept, with regard to the Users of the Site and the Users of the Ask Mona chatbot available on the Site, for the time necessary to provide a response, and at most 3 years from the last exchange.
Personal data may be used to improve and personalise the service.

A User may request the deletion of information that has been extracted from messages sent via the e-mail address contact@askmona.fr.

The personal data collected is never sold or rented to a third party.

Pursuant to Law No. 78-17 of 6 January 1978, as amended by Law No. 2004-801 of 6 August 2004 on information technology, files and freedoms, and to European Regulation No. 2016/679/EU of 27 April 2016, each User has the right to oppose, access, portability, limit and rectify data concerning him/her. They may thus demand that information concerning them be rectified, completed, clarified, updated or deleted. Each User can exercise this right at any time by contacting Ask Mona via the email address
contact@askmona.fr. Each User can make a complaint to the CNIL concerning his personal data.

4.2 Children under 15 years old

If you are under 15 years of age, please do not use this Service and do not disclose your personal information to Ask Mona without the prior consent of your parent or legal guardian. We encourage parents and guardians to monitor their children’s Internet use and to help us strengthen the protection of our Users’ personal information by instructing their children not to disclose their personal information to Ask Mona without their permission. If you have reason to believe that a child under the age of 15 has provided personal information to Ask Mona without the consent of his or her parent or legal guardian, please contact us at contact@askmona.fr

4.3 Cookies

Browsing this site may cause cookies to be installed on the User’s computer. A cookie is a small file that records information about the navigation of a computer on our Site. The data thus obtained is intended to facilitate subsequent browsing on the Site, and is also intended to allow various measures of frequentation. Refusing to install a cookie may make it impossible to access certain services. The User may, however, configure his or her browser at any time to oppose the recording of cookies or to delete them.

4.4 External links

The Site may contain links to third party content that does not originate from Ask Mona. Ask Mona does not endorse or assume any responsibility for such third party sites, information, content, products, or services. The User’s use of such third party sites or services is at his own risk.

ARTICLE 5.

APPLICABLE LAW AND JURISDICTION

The contractual relations resulting from the use of the site and Ask Mona are subjected to the French law, and are of the exclusive competence of the French jurisdictions.

SAS ASK MONA COPYRIGHT

All content available on the site (text, software, scripts, graphics, photos, sounds, music, graphic interface) are the exclusive property of SAS ASKMONA or, if not, have been authorized for use and are therefore protected by the Intellectual Property Code.
